Giving Terms
Terms of use of the dar.kolegium.org giving portal
These terms govern how Kolégium Antona Neuwirtha (“Kolégium”) accepts gifts through the giving portal dar.kolegium.org (the “portal”), what a donor can expect from Kolégium, how a donor manages their recurring support, and how personal campaigns work. The terms are published at dar.kolegium.org/pravidla-darovania and apply to every gift made through the portal. By making a gift on the portal, the donor confirms that they have read these terms and acknowledges them.
Definitions
- For the purposes of these terms:
- the portal means the website dar.kolegium.org, including its My Giving section;
- a donor means a natural or legal person who makes a gift to Kolégium through the portal;
- a gift means a voluntary monetary gift made to Kolégium without any entitlement to consideration in return, either as a one-time gift or as recurring monthly support;
- a campaign (referred to on the Slovak version of the portal as a “zbierka”) means the purpose for which the donor designates their gift (for example, building the Kolégium Campus, or the annual campaign for Kolégium’s day-to-day operations);
- a personal campaign means a page on the portal that a donor with an account in My Giving creates in order to raise gifts for one Kolégium campaign;
- the payment gateway means a third-party service through which card payments and Apple Pay and Google Pay payments are made on the portal; at the time these terms take effect, this is the Finby payment gateway.
- The portal is operated by Kolégium. Kolégium is a non-profit organization dedicated to the education of young people and funds its activities mainly through gifts.
Nature of the gift
- A gift is voluntary. Making a gift creates a gift contract between the donor and Kolégium under Section 628 et seq. of the Slovak Civil Code. Kolégium accepts the gift at the moment it is credited to Kolégium’s account.
- A gift is not a payment for goods or services. The general terms and conditions of Kolégium’s online shop do not apply to gifts made through the portal.
- The donor is not entitled to anything in return for the gift. Kolégium thanks the donor for the gift and keeps them informed about how it uses gifts.
How a gift is made
- On the portal, the donor chooses the campaign, the amount of the gift and whether it is a one-time gift or recurring monthly support, and enters their first name, last name and email address. The minimum for both a one-time gift and monthly support is €1.
- A one-time gift can be paid by payment card, via Apple Pay or Google Pay (if the donor’s device supports them), or by bank transfer. Recurring monthly support can be given by payment card, also via Apple Pay or Google Pay (if the donor’s device supports them), or by a standing order from the donor’s bank. A gift above €10,000 can only be sent by bank transfer, and recurring support above €10,000 per month only by standing order.
- Payments by card, via Apple Pay and via Google Pay take place on the payment gateway’s page. Kolégium has no access to the full payment card number or its security code and does not store this data. The payment gateway passes to Kolégium only the masked card number, showing the last four digits, and the month and year in which the card expires; these are used for display in My Giving and for managing recurring support.
- A gift paid by card, via Apple Pay or via Google Pay is made when the payment gateway confirms the payment to Kolégium. Kolégium sends the donor a confirmation of receipt of a one-time gift by email.
- If a card payment does not go through, Kolégium charges the donor nothing. The donor may repeat the payment or choose a bank transfer. After a failed or interrupted payment, Kolégium may send the donor one email with a link to complete the gift. If the donor has consented to receive updates from Kolégium, Kolégium may remind them of the unfinished gift at most two more times; the donor can stop further reminders using a link in the email.
- If the donor chooses a bank transfer, the portal displays the payment details and sends them by email: Kolégium’s account number (IBAN), the amount, the variable symbol and a PAY by square QR code. The variable symbol is used to match the payment to the gift, so the donor includes it with the payment. Kolégium matches the payment to the gift once it has been credited to Kolégium’s account and then sends the donor a confirmation by email.
- The donor sets up, changes and cancels recurring support by standing order at their own bank, quoting the same variable symbol every month. Kolégium does not manage this support through the portal and does not collect anything from the donor’s account. After the first payment has been matched, Kolégium thanks the donor by email; it does not confirm subsequent monthly payments separately.
- Kolégium may temporarily suspend or restrict card payments if it detects an unusual number of failed payments or other signs of payment card misuse. In that case, the donor can send the gift by bank transfer.
Recurring monthly support by payment card
- By setting up recurring monthly support by payment card, the donor agrees that Kolégium will, through the payment gateway, charge the chosen amount to the donor’s payment card every month until the donor cancels the support or it is ended in accordance with these terms.
- If the donor sets up recurring support via Apple Pay or Google Pay, subsequent monthly payments are charged to the payment card the donor used for it in the wallet.
- The first payment is made when the support is set up. Each subsequent payment is made monthly on the same day of the month on which the support was set up. If the support was set up on the 29th, 30th or 31st day of a month, subsequent payments are made on the 28th day of the month.
- Kolégium confirms the setup of the support to the donor by email. Kolégium does not send the donor a separate confirmation of individual monthly payments.
- The donor may change the amount of recurring support at any time in My Giving. The new amount applies from the next monthly payment; changing the amount does not change the payment date. The minimum monthly support is €1. The donor confirms an increase on a separate page, and Kolégium confirms it to the donor by email. If the new amount exceeds twice the amount the donor last authorized in the payment gateway and also exceeds it by more than €50, the donor also confirms the increase by verifying the payment card in the payment gateway; nothing is charged to the card during verification, and the new amount applies only after successful verification.
- The donor may cancel recurring support at any time in My Giving or by email to podporit@kolegium.org, without giving a reason and free of charge. Cancellation in My Giving takes effect immediately; Kolégium carries out cancellation by email without undue delay. No scheduled monthly payment is made after cancellation. Payments made before cancellation remain gifts. Kolégium confirms the cancellation of the support to the donor by email.
- If the bank declines a monthly payment, Kolégium retries it at most three times, on the third, seventh and fourteenth day after the original date. Kolégium informs the donor of each failed payment by email. If the last attempt also fails, Kolégium ends the recurring support and informs the donor of this in the same email. The donor may set up the support again at any time.
- The donor may change the payment card from which recurring support is charged in My Giving. The donor verifies the new card in the payment gateway; nothing is charged to it during verification. The support continues without any change to the amount or the payment dates. If the card expires and the bank replaces it with a new one, the payment gateway may update the card details for recurring support automatically.
- Kolégium may end recurring support on its own if it cannot be carried out over a long period, or if the donor requests this in another verifiable way. Kolégium informs the donor of the ending by email.
My Giving
- The My Giving section of the portal at dar.kolegium.org/moja-podpora allows the donor to manage their recurring support and personal campaigns. The donor signs in by entering their email address; Kolégium sends a six-digit sign-in code to that address. The code is valid for 15 minutes, can be used only once and only in the browser in which the donor requested it, and stops being valid after five incorrect attempts.
- If the donor does not yet have an account at the address entered, they can create one after entering the code; when doing so, they provide their first name and last name. When an account is created, Kolégium records the time, the version of these terms in effect and the IP address from which the account was created.
- In My Giving, the donor sees their recurring support by payment card and their personal campaigns. The donor can change the amount of support, cancel it, change the payment card, make another gift, update their contact details, give or withdraw consent to receive updates from Kolégium, and change their email address. A list of individual payments is not shown in My Giving.
- A change of email address takes effect only after it has been confirmed through a link sent to the new address. The link is valid for 30 minutes and can be used only once. Kolégium also informs the original address of the change.
- Access to My Giving is tied to the donor’s email inbox. The donor therefore takes care to keep it secure and does not share the sign-in code with anyone else.
- If someone receives an email about a gift or recurring support that they did not make, they should notify Kolégium at podporit@kolegium.org. Kolégium will look into the matter and, depending on the circumstances, cancel the support, refund the gift or correct the donor’s email address.
Personal campaigns
- A personal campaign can be created by a donor who has an account in My Giving and has entered their telephone number there. At the donor’s request, Kolégium may also create it on the donor’s behalf. A personal campaign always raises gifts for one Kolégium campaign that is currently running. Once the personal campaign has been published, this Kolégium campaign cannot be changed.
- A personal campaign contains the author’s name, the author’s text of no more than 400 characters, optionally the author’s photo, and an end date. The public page of a personal campaign shows the author’s first name in the heading, the author’s full name, the text, the photo and the total amount of gifts raised.
- A personal campaign is published immediately, without prior approval by Kolégium. It is accessible only through its own address, is not publicly listed anywhere on the portal and is not indexed by search engines.
- The author of a personal campaign is responsible for its content. The text must not contain an account number to which money should be sent, or anything that is contrary to the law, to good morals or to Kolégium’s mission. Kolégium monitors published personal campaigns and changes to them and may hide a personal campaign at any time, including without notifying the author in advance.
- All gifts made through a personal campaign are gifts to Kolégium for the campaign for which the personal campaign was created and are credited directly to Kolégium’s account. The author of the personal campaign acquires no rights to the gifts. Only a one-time gift can be made through a personal campaign; the same rules apply to its amount and method of payment as to other one-time gifts.
- The author of a personal campaign sees only the total amount and the number of gifts received through it. The author does not see donors’ names, their contact details or the amounts of individual gifts.
- A personal campaign ends on the date set by the author, when the Kolégium campaign for which it was created ends, or when the author ends it. The page of an ended personal campaign remains accessible, but gifts can no longer be made through it. If a personal campaign ends because its end date has passed or because the Kolégium campaign has ended, Kolégium informs the author by email. An unpublished draft of a personal campaign that the author has not worked on for 30 days is deleted.
Use of the gift
- Kolégium uses the gift for the purpose of the campaign chosen by the donor and for its activities in accordance with its mission.
- If the purpose of a campaign has been fulfilled, the campaign ends, or its purpose cannot be fulfilled for objective reasons, Kolégium uses the gift for another purpose that is closest to the original purpose and consistent with Kolégium’s mission. In that case, Kolégium redirects recurring support by payment card or by standing order to another of its running campaigns and informs the donor of this by email. The amount and dates of payments do not change; for a standing order, the donor does not need to change anything at their bank, and Kolégium records the donor’s subsequent payments under the new campaign. The donor may cancel the support at any time in accordance with these terms.
- The campaign status and the indicators on the giving pages and in personal campaigns are for information only. The campaign status includes gifts received both through the portal and outside it.
Refund of a gift
- A gift is voluntary and, as a rule, is not returned once it has been accepted.
- If a gift was made by mistake, in particular a duplicate payment or an incorrectly entered amount, if a monthly payment was made despite the recurring support having been cancelled, or if the gift was made by another person without the knowledge of the holder of the email address, Kolégium will refund the gift on request. The donor sends a refund request to podporit@kolegium.org. Kolégium assesses it without undue delay.
- Kolégium usually refunds a gift paid by card, via Apple Pay or via Google Pay through the payment gateway to the same payment card. A gift sent by bank transfer or standing order, as well as a gift that cannot be refunded to a payment card, is refunded by Kolégium by bank transfer to the account (IBAN) that the donor provides for this purpose. Kolégium informs the donor of the refund by email.
Personal data and communication
- Kolégium processes the donor’s personal data in order to handle the gift, to keep records of donors and to meet its legal obligations. Detailed information about the processing of personal data and about the donor’s rights is provided in the Personal Data Protection document at kolegium.org/ochrana-osobnych-udajov.
- Kolégium always sends operational emails relating to a gift, an account or a personal campaign (in particular confirmation of a gift, bank transfer details, the setup, increase, cancellation or redirection of recurring support to another campaign, a failed payment and a link to complete an unfinished gift, a refund of a gift, a sign-in code, a change of email address, and the publication and ending of a personal campaign), because without them the donor would not know what has happened to their gift or account. Kolégium sends other communication, including reminders of an unfinished gift, only with the donor’s consent to receive updates from Kolégium, which the donor may withdraw at any time in My Giving or by email to podporit@kolegium.org.
- The portal does not use cookies to track donors or third-party tools to measure traffic. Kolégium measures traffic itself, without cookies and without storing IP addresses. A technical cookie is used only on pages with a form or a sign-in, to sign in to My Giving and to secure forms.
Payment security
- Payments by card, via Apple Pay and via Google Pay are processed by the payment gateway, which is operated by a licensed payment institution. Kolégium has no access to full payment card details and does not store them.
- Kolégium may refuse a payment or refund a gift already accepted if it has reasonable grounds to suspect that the payment card was used without the cardholder’s consent.
Final provisions
- These terms and the relationships arising from them are governed by the laws of the Slovak Republic.
- Kolégium may change these terms. It publishes the new version on the portal together with the date on which it takes effect. Kolégium informs donors with active recurring support by email at least 14 days before a change that materially affects recurring support takes effect. A gift is governed by the terms in effect when it is made; monthly payments of recurring support are governed by the terms in effect at the time of payment.
- These terms are drawn up in the Slovak language. If Kolégium also publishes a translation into another language, the Slovak version prevails in the event of any discrepancy between the language versions.
- Donors may send questions, requests and suggestions concerning gifts to podporit@kolegium.org.
